The Application obtains the information you provide when you:
a. purchase a subscription to The Main Street Data Company Biz Street,
b. download the Application
c. and register your data (POS and Business information) on the Application.
When you register with us and use the Application, you generally provide (a) your name, email address, age, user name, password and other registration information; (b) transaction-related information, such as your POS data, respond to any offers, or download or use applications from us; (c) information you provide us when you contact us for help; (d) credit card information for purchase and use of the Application, and; (e) information you enter into our system when using the Application, such as contact information and project management information. We may also use the information you provided us to contact your from time to time to provide you with important information, required notices and marketing promotions.
In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.
As a condition of your use of the Application, you agree that:
You have reached the age of majority in the state or province in which you reside; You are able to create a binding legal obligation;
You have the right to provide any and all information you submit to the Application, and all such information is accurate, true, current, and complete;
You will update and correct information you have submitted to the Application and ensure that it is accurate at all times (out-of-date information will invalidate your account); and,
1.Submitting any content to the Application that:
Violates applicable laws (including, without limitation, intellectual property laws, laws relating to rights of privacy and rights of publicity, and laws related to defamation);
Contains personal information, except when we expressly ask you to provide such information;
Contains viruses or malware;
Has the effect of impersonating others;
Contains messages by non-spokesperson employees of MSDC purporting to speak on behalf of MSDC or provides confidential information concerning MSDC;
Contains chain letters of any kind;
Is purposely inaccurate, commits fraud, or falsifies information in connection with your MSDC account or to create multiple MSDC accounts; or
Is protected by copyright, trademark, or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right.
2.Attempting to do or actually doing any of the following:
Accessing data not intended for you, such as logging into a server or an account which you are not authorized to access;
Scanning or monitoring the Application for data gathering purposes in an effort to track sales, usage, aggregate offering information, pricing information, or similar data;
Scanning or testing the security or configuration of the Application or breaching security or authentication measures; or
Interfering with service to any user in any manner, including, without limitation, by means of submitting a virus to the Application or attempting to overload, “flood,” “spam,” “mail bomb,” or “crash” the Application.
3.Using any of the following:
Frames, framing techniques, or framing technology to enclose any content included on the Application without our express written permission;
Any Application content, including, without limitation, User Content (defined below), in any meta tags or any other “hidden text” techniques or technologies without our express written permission;
The Application or any of its contents to advertise or solicit, for any commercial, political, or religious purpose or to compete, directly or indirectly, with MSDC; or
The Application or any of its resources to solicit consumers, Merchants, or other third-parties to become users or partners of other online or offline services directly or indirectly competitive or potentially competitive with MSDC.
4.Collecting any of the following:
Content from the Application that diverts traffic from the Application without our express written permission; or
5.Engaging in any of the following:
Tampering or interfering with the proper functioning of any part, page, or area of the Application or any functions or services provided by MSDC;
Taking any action that places excessive demand on our services or imposes, or may impose, an unreasonable or disproportionately large load on our servers or other portion of our infrastructure (as determined in our sole discretion);
Reselling or repurposing your access to the Application or any purchases made through the Application;
Accessing, monitoring, or copying any content from the Application using any “robot,” “spider,” “scraper,” or other automated means or any manual process for any purpose without our express written permission;
Violating the restrictions in any robot exclusion headers on the Application or bypassing or circumventing other measures employed to prevent or limit access to the Application;
Deep-linking to any portion of the Application without our express written permission;
Hyperlinking to the Application from any other website without our initial and ongoing consent; or
Acting illegally or maliciously against the business interests or reputation of MSDC, our Merchants, or our services.
When you visit the mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map with relevant advertisements. We will not share your current location with other users or partners.
If you do not want us to use your location for the purposes set forth above, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.
We will share your information with third parties only in the ways that are described in this privacy statement.
We may disclose User Provided and Automatically Collected Information:
as required by law, such as to comply with a subpoena, or similar legal process;
when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.
if Main Street Data Company LLC, is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Website of any change in ownership or uses of this information, as well as any choices you may have regarding this information.
You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at [email protected]
We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at [email protected] and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.
We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at [email protected] . We will delete such information from our files within a reasonable time.
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application.
